If you listen to that clip I am clearly talking about why money from outside individuals can't be forwarded into a studio-funded production per SEC rules back in July 2011. Kickstarter's backer/reward model avoids those issues.
Furthermore, securities laws have changed substantially since then when the JOBS Act was signed on April 5, 2012. (a full 9 months after the clip you site)
